To work in the plant-touching sectors of the legal cannabis industry in the US (with the exception of hemp), individuals must:

  1. Be at least 21 years old.

Beyond that, it depends on the individual state.

Badging Requirements:
Some states require workers to obtain a special badge or permit to work in specific sectors of the industry while others do not.
Examples of states that do include: Colorado, Oregon, and Illinois.
Examples of states that do not include: California, Washington, and Michigan.

Background Checks:
Some states require licensed cannabis employers to background check their employees, while others do not.  States that have badging requirements typically include a background check in the badging process.  Whether required or not, most cannabis industry employers conduct background checks regardless to ensure that employees are trustworthy and likely to comply with state laws and regulations so they don’t put the businesses’ license(s) in jeopardy.

With that said, a growing number of states and localities have also implemented Ban the Box laws that restrict employers from inquiring about an applicant’s criminal history early in the hiring process.
