What are the legal requirements to work in Colorado’s cannabis industry?

Legal requirements to work in the cannabis industry

To work in the plant-touching sectors of the legal cannabis industry in Colorado, individuals must obtain a Marijuana Employee License (or “MED Badge”) issued by the Colorado Marijuana Enforcement Division (MED).  A Marijuana Employee License is required for employees of MED-licensed cannabis businesses, including producers, processors, wholesalers, and retailers.

Here are the key steps and requirements:

  1. Age: Individuals must be at least 21 years old to apply.
  2. Application: The application process includes completing an application form, and providing a valid photo ID.
  3. Fingerprinting: All applicants must submit to fingerprinting as part of their application.  While using a third-party fingerprinting service is an option, the MED’s fingerprinting service costs approximately $40.
  4. Application Fee: Applicants will need to pay a $150 application fee to submit their application for review.
  5. Background Check: A background check is performed on all applicants as part of the application process. Certain criminal convictions may disqualify individuals from obtaining a permit.*

* While The Colorado Marijuana Enforcement Division (MED) evaluates criminal history on a case-by-case basis when reviewing applications, the following may disqualify you from obtaining a permit:

  • Recent Felony Convictions: Any felony conviction within the past five years, especially ones involving fraud, deceit, embezzlement, or theft.
  • Multiple Convictions: Multiple convictions increase the likelihood that your application will get rejected.
  • License or Permit Revocations: If an individual’s previous Colorado MED Badge or cannabis license was revoked due to violations of relevant Colorado statutes or rules, this could also lead to disqualification.
  • False Statements: Omission or falsification of any information on the application form can also result in the denial of the application.

PLEASE NOTE: A MED Badge is not required to work for an ancillary firm in Colorado’s cannabis industry, so long as that company does not grow, process, or sell cannabis or cannabis products.
